This was Michael Behenna's last chance for justice.
The 28 year-old Army first lieutenant from Oklahoma, who was railroaded into the Leavenworth DB after JAG prosecutors - read persecutors (who need to see the inside of a jail cell themselves) - were caught obstructing justice, got some good news this week when the U.S. Army Court of Appeals for the Armed Forces agreed to study Behenna's claims the judge gave the jury "faulty instructions" and the prosecution deliberately withheld information from the defense that could have seriously undermined their already shaky case.
MilitaryCorruption.com has learned that the court will begin the examination sometime in March. Meanwhile, Behenna faces 13 more years in the slammer for allegedly murdering an Iraqi detainee. He was convicted in 2009 and his original 25 year stretch has been cut back to 15 years. However, objective observers contend the conviction was more political than just, and hope the lieutenant will get a new trial, if not total vindication and release.
"PC POLITICS" PLAYED PART IN BEHENNA'S PUNISHMENT
Sources say the Obama administration is wary in an election year to do anything that might alienate Muslim voters in the United States. The so-called "victim," Ali Mansour Mohammed, and the fanatic Muslim Army major at Ft. Hood who killed many Americans in cold blood more than two years ago - and has yet to be brought to trial - are "heroes" in some people's minds.
Michael Behenna's conviction on "murder" charges, we feel, is the result of "PC politics." This officer has been thrown to the wolves, who don't care about guilt or innocence, just currying favor with the Pentagon and getting that next promotion.
However, "hard-nosed" prosecution and "throwing the book" at a service member is one thing. That's what career-minded JAG officers do. But deliberately concealing information that could have affected the outcome of the case is another.
PROSECUTION'S EXPERT WITNESS BELIEVED LT TOLD TRUTH
In a shocking development, an expert witness that was set to be called to the stand by the JAG, was held back and his conclusions concealed when he told them his findings pointed to Behenna telling the truth about the fatal shot being fired in self-defense. The young officer had testified he'd pulled the trigger as he and the detainee were talking when Mohammed suddenly rose to his feet and lunged for Behenna's loaded handgun.
Vicki Behenna, the imprisoned officer's mom, who is an asst. U.S. attorney for the eastern district of Oklahoma, was pleased with the latest news, but cautious after fighting the past two years for her son's freedom. "All we ever asked for was justice and a fair trial," she said.
