The youngster's parents didn't want to go though the trauma of another trial, so civilian cops in Curry County, N.M. who'd nabbed Bitner in the first place, and the local district attorney, agreed to drop charges if the Air Force court-martialed the 30 year-old officer.
They did. So the family "will not have to go through the ordeal of a second trial," DA Matt Chandler told us.
According to court papers, Bitner "fondled" the young boy several times while visiting the kid's parents not far from the air base. The violations were made during the night, officials reported.
Bitner was initially taken into custody last June and hit with four counts of "criminal misconduct" with a minor.
The physician's assistant caught another break with the brief incarceration period. You have to have at least a three year sentence to get sent to the DB these days, so Bitner will escape seeing the walls of Leavenworth Prison or being "greeted" by a "welcoming committee" in the shower room.
