We think it's big news when a very senior JAG officer is court-martialed for offenses he may well have sent others to jail for, or at least ended their careers with disgrace and loss of pension and benefits.

Once again, we have scooped "mainstream media" outlets like Army TIMES and the Associated Press, who have yet to write word one about the court-martial and guilty plea of COL Stephen Spelman, self-described in his hometown newspaper as a "loyal Democrat" and Obama supporter.

You see, up until a few days ago, Spelman had led a story-book life. As an assistant district attorney for Hampden County in deeply Blue Massachusetts, all the ink on him in the daily Springfield newspaper had been adoring. We learned about his outstanding military career, service in Iraq, award of the Bronze Star (meritorious) and Legion of Merit, and how much this family man missed his daughters while away at war.

In a 2006 article in the local paper, a reporter wrote: Despite the dangers of his military job (Iraq) and his list of accomplishments and honors, he (Spelman) has said being separated from his two girls was among the most difficult crosses to bear during his tour in Iraq. "Dad," (the colonel) has said, "is the most important title I carry."

The 55 year-old politician and former prosecutor may be singing a different tune these days.

A "MEMO" YOU WEREN'T MEANT TO SEE

I want to share with all personnel of Legal Command the results of a court-martial, United States v Spelman, which was convened on 6 Sept 2012. While the Convening Authority must act on the adjudged sentence before it becomes final, I believe our personnel have an interest in knowing the result of the trial adjudicated yesterday. It is my intent and hope that this announcement will dispel inaccurate rumors and control misinformation.

As many of you are aware, COL Stephen Spelman was formerly assigned as the Deputy Commander of Legal Command. During his tenure as Deputy Commander, an investigation was conducted into allegations of misconduct made against him. The alleged misconduct occurred prior to COL Spelman's assignment as Deputy Commander. In April, this year, after the investigation was completed, COL Spelman was ordered to active duty after UCMJ charges were preferred against him.

In July, COL Spelman submitted an Offer to Plead Guilty, which was approved by the Convening Authority in the Military District of Washington.

A court-martial was convened at Ft. McNair in Washington, D.C. COL Spelman pled guilty to three charges and these specifications: Article 120, INDECENT ACTS; Article 92, two specifications of violation of a Lawful Regulation (AR 600-20) by engaging in a PROHIBITED RELATIONSHIP with a subordinate; and ADULTERY. Consistent with his pleas of guilty, the court found COL Spelman guilty and imposed sentence. The Court's sentence included the following: reprimand; forfeiture of $4000 a month for five months; and 60 days confinement.

The sentence must now be reviewed by the Convening Authority, who must take action before any sentence is deemed final. The Convening Authority has the authority to grant clemency on any or all portions of the sentence, or to approve the sentence as adjudged.

While we have been unable to get confirmation from the Pentagon, and this "memorandum" may have been sent us as an elaborate hoax to set us up, MilitaryCorrupton.com feels there is enough news here to present it to our readership.

DOUBLE-STANDARD FOR JAG OFFICERS

In light of past misdeeds by former Maj. Gen. Thomas J. Fiscus, onetime chief JAG of the U.S. Air Force; USAF Col. Michael Murphy; and others such as West Point grad, JAG officer and child porn producer, MAJ Dan Woolverton, we would be remiss to ignore the above. However, in the spirit of fairness, we offer COL Spelman and any other interested parties, equal space on these pages to present their side of the story if they so desire.

As to the "punishment" to be decided upon for Spelman, for what it's worth, here is our prediction.

The colonel has already accumulated 30 years of military service and could retire, albeit at a lower grade, at any time. While a reprimand is not a nice thing to have in one's file, it would be relatively meaningless if Spelman were to hang up his uniform for good. The $20,000 fine wouldn't be all that difficult to pay. It's the "60 days confinement" that jumps out at us.

We sincerely doubt the Army would put any bird colonel in the lockup for even an overnight visit. Remember COL Johnson? That part of the "sentence" will likely be scrapped. Of course, if Spelman had been a sergeant or junior officer, then, he would have done hard time, after all. But, in reality, he's a politically-connected 0-6 who will likely get off with the reprimand, fine, and retirement at either his present rank or one grade lower than he now holds.

As we have said here a number of times in the past 12 years, in the military it is DIFFERENT SPANKS FOR DIFFERENT RANKS. Hammer the enlisted people and NCO's, while the fat cats and brass hats are let off with a "slap-on-the-wrist."
