SURPRISE AT START OF SODOMY COURT
On paper it looked like a slam-dunk. An Air Force captain had been arrested after being accused of drugging and then date-raping several male victims. At least four persons said they'd been sodomized after something was slipped in their drinks while socializing off-post with the effeminate-looking medical officer.
Capt. Devery Taylor was hit with four counts of forcible rape; three counts of kidnapping; two counts of attempted sodomy; and - apparently the gumshoes failed to see the irony on the wording of the next charge - "illegal entry." All that, if proven, would be sure to send the unfortunate officer to Leavenworth for perhaps the rest of his life.
"Woo hoo! We got a good one here," said the OSI sleuths as they licked their chops, starting to gather "evidence" in what they thought would be an open and shut case. But somewhere between the start of the investigation in the summer of 2005 and now, the once solid-looking case started to fall apart.
A WEAK PROSECUTION CASE, POORLY PREPARED
First of all, military cops couldn't find any GHB, or "date rape" drug after ransacking Capt. Taylor's car, home computer and abode on Okaloosa Island, a few miles from the 38 year-old officer's job at Eglin AFB hospital. Then, when they did turn up four "x-rated" photos out of thousands scanned on the captain's confiscated PC, none of the males depicted there resembled any of the complainants. In fact, as sharp USAF defense attorney Capt. Amy Jordan pointed out to Judge Thomas Cumbie, none of the images, while clearly of a sexual nature, were "illegal to have."
The female JAG, who apparently is not planning on a long career in the Air Force - she's putting up far too vigorous a defense for her client than the brass usually expect or get for her to survive for long wearing blue - said the use of photographs that had no direct connection with the case at hand was an obvious attempt by the prosecution to "inflame" the jury. She's right.
Made up of officers in the rank of major and above, it could be expected they would be repulsed by photos of any homosexual acts and thus feel even more hostile to Capt. Taylor, whom you can see from his pix above, does not exactly look like "Mr. Macho Man."
MARTIN REGAN JR.—HARD-CHARGING
The lead defense lawyer, a hard-charging civilian, Martin Regan Jr., was quick on his feet, confronting one accuser with the pointed question: "Are you a homosexual?" The rattled first lieutenant (court papers show he was a technical sergeant E-6 back on June 18, 2004 when he was allegedly "drugged" and "date-raped,") said he wasn't gay.
Regan hammered away at the lieutenant, demanding to know why the officer took so long - more than a year - to report the "assault." .
"You don't even know whether you were raped or not, do you?" the defense attorney shouted.
"No, sir," the first lieutenant said.
The crafty Regan wanted to know if the witness was hiding the true nature of his relationship with Taylor. Perhaps the motive was to protect his career, as all the accusers at the Article 32 preliminary hearing had testified under oath that they were not homosexuals. If facts came to light later on that disprove that testimony, those caught lying would face, at the very least, being kicked out of the Air Force.
MilitaryCorruption.com has learned the defense team has at least three witnesses who are ready to testify that some of Taylor's accusers were "consensual sex partners" with the captain; that they knew he was "gay" and had ulterior motives for making accusations of drugging and date rape.
Regan rattled another witness on the stand with his rapid-fire, unrelenting questioning. A civilian medical technician who admitted he'd been with Taylor on several prior occasions, insisted his drink was spiked at Taylor's Bluefish Drive residence. And he declared he was sodomized against his will.
The nervous witness denied being "gay" during his testimony, and at one point, said he rejected the label of homosexual because, get this, he wanted to be "treated as a person." Hmmmmm.
Regan hammered away at the med tech's credibility, or lack of same. The aggressive attorney suggested the alleged "victim" would "do or say anything" to make sure he could join the Navy. Thus, his claim of "involuntary sodomy" would cover him in case questions about that came up while talking with a Navy recruiter, the defense lawyer said.
"You were afraid of being exposed, weren't you?" Regan thundered.
"No," squeaked the witness.
The sensational court-martial is expected to continue for several more days, and MCC will be running frequent updates to let you know all the inside details.
LOTS OF GAYS WORK AT EGLIN AFB
HOSPITAL, SOURCE SAYS.
Will Capt. Taylor be kicked out of the Air Force for homosexual activity? Is the Pope Catholic? The best the officer can hope for is to escape spending the rest of his life looking over his shoulder in the shower room at the DB. From what we've seen so far of the prosecution's case, Maj. Kathleen Reder needs a remedial course of how to prepare a successful prosecution. Nailing Taylor for being a homosexual is the easy part. That's like taking candy from a baby. Proving that he date-raped and kidnapped four grown men who were drinking and socializing in private with the "light-in-the-loafers" captain is tough when the evidence just isn't there.
In fact, the Eglin AFB hospital is full of gays, if a source at the base is correct. An enlisted person who works there told one of our confidential informants on the ground in Florida that if the OSI was interested in rounding up a bunch of homosexuals, all they need do was back a truck up to the hospital.
"There's gays among the male and female enlisted as well as doctors and nurses," the source said. "I would guess they'd have to shut the place down if they raided us and got them all. But they won't, because it would be too counterproductive. At Eglin, the OSI goes after who they're told to get, and leaves other people alone."
