FORT BRAGG, N.C. The defense won a minor skirmish in the GEN Jeffrey Sinclair sex crime court martial here Tuesday when the judge refused to allow JAG prosecutors to introduce voluminous amounts of pornographic material - sex videos and images from Sinclair's personal computer - into the proceedings as far as deciding if the smut had any relation to assault charges.
The most serious hurdle facing the former deputy commander of the 82nd Airborne is the contention by his accuser and ex-girlfriend that on one or two occasions he "forced" her to give him oral sex. If found guilty of that crime, Sinclair could end up at the Leavenworth DB for the next 30 years. He is currently 51 years old and has 27 years of military service.
Defense lawyer Ellen Brotman said showing the explicit images to the jury "would be inflammatory and prejudicial." She decried it as an attempt by the prosecution to "turn this courtroom into a pornographic theater to prejudice the members of the panel."
Apparently the judge agreed, at least in part. However, COL Pohl ruled that some of the material could be used as evidence that Sinclair had violated the prohibition against having pornographic material in a combat zone.
All five members of the jury were seated without challenge. They are major generals Donald C. Leins, Joint Staff at the Pentagon; M. Ted Wong, CG of the Northern Region, Medical Command; Dean G. Sienko, CG of the Army Public Health Command; Paul E. Crandall, deputy chief-of-staff, U.S. Forces, Korea; and John F. Wharton, CG of the U.S. Army Sustenance Command.
A GLARING DOUBLE-STANDARD
One name not uttered in the courtroom, and unlikely to be, is that of former Air Force Maj. Gen. Thomas J. Fiscus. Some years back (see related stories box below), we at MCC helped expose him - the USAF top JAG attorney - as a phony, fake and fraud.
Fiscus later admitted he had sex with up to two dozen female subordinates, both officer and enlisted. His cronies made sure he got off with a slap-on-the-wrist. The lucky two-star was reduced in retired rank to colonel, but was allowed to keep his pension and not go to jail.
Likewise, the perfumed prince, retired GEN David Petraeus, remains unpunished (under the UCMJ) for his admitted sexual affair with fellow ring-knocker Paula Broadwell.
And onetime commander-in-chief Bill Clinton got away with getting BJ's under his desk in the Oral Office from Monica Lewinsky while President of the United States.
Having a mistress is something a majority of military flag officers consider a perk of rank. What about GEN Dwight Eisenhower and his driver/lover, CPT Kay Summersby? Ike was married to Mamie, and it was wartime. President Harry Truman and Army Chief of Staff GEN George Marshall were aware of Eisenhower's cheating, but he never faced charges under the UCMJ.
Sinclair is being prosecuted for personal and political reasons. The stench of hypocrisy in this courtroom hangs heavy as a barn full of cow manure on a hot summer day.
