Marine PFC Joseph Pemberton could get up to 40 years in prison for the brutal slaying of a Filipina prostitute.
Jennifer Laude, a 26 year-old transsexual from Olongopo City, was killed in October after going into a hot sheet hotel with the horny Marine.
Not long after that, hotel staffers saw the Marine quickly leave the room. Inside, they discovered Laude's half-nude body, her head shoved into a toilet bowl. She had been strangled to death.
LOCAL AUTHORITIES WANT CUSTODY OF MARINE
Philippine prosecutors want Pemberton transferred from U.S. to local custody. He's presently being held in a container van parked at Camp Aguinaldo, military headquarters in Quezon City. But the U.S. still retains control of the young Marine. That could change soon.
The United States is balking at the request, citing the 1988 Visiting Forces Agreement, under which Filipino courts have jurisdiction in cases involving American military members accused of crimes.
The agreement also allows suspects to remain in United States custody. Its terms are that the Philippine Government has one year to prosecute an American and secure a conviction. Once a warrant is issued, however, as is the case here, the Philippines can immediately assert custody over PFC Pemberton.

Our sources in the Philippines tell us that Prosecutor Emilie de Santos has a very strong case. They cite a statement, allegedly given her by a Pemberton Marine buddy saying he admitted committing a murder after a night of heavy drinking in Olongopo.
"I think I killed a he/she," the private allegedly said. MilitaryCorruption.com has learned the identity of the Pemberton pal. He is L/CPL Jarin Michael Rose.
Rose reportedly said in a sworn statement that Pemberton described getting angry finding out Laude was a transsexual and put the petite victim into a two-minute long headlock.
Once her body became limp, the statement continued, Pemberton dragged Laude's body to the toilet and pushed her head into the toilet bowl.
