Who's the luckiest officer in the Air Force today? No, not Jill Metzger, the pampered and protected poster girl who claimed she was kidnapped in Kyrgyzstan and parlayed that alleged lie into a lucrative 100% "disability" pension while going on the TDRL and running in marathons across the country. It's Col. Michael Murphy, a onetime top JAG who it looks like is going to "skate" and escape any punishment despite some very serious charges lodged against him.

That can't be good news for some of the former Air Force personnel now occupying cells at the Leavenworth DB. They won't be thrilled to know that an officer who may have helped send them there - guilty or innocent - was himself hiding the fact he'd been disbarred in two states for over twenty years.

If a civilian attorney had pulled a stunt like that, there would be hell to pay, and a lot of convictions would end up before the court of appeals. But this isn't the real world - it's the Air Force - where rats like former top legal officer, then-Maj. Gen. Thomas J. Fiscus, can have sex with and promote the careers of more than two dozen women under his command, yet never even face an Article 32 hearing.

Fiscus got the proverbial "slap-on-the-wrist" and laughs all the way to the bank as he cashes his 0-6 pension check, knowing if he was a lower-ranking officer or enlisted member, he could have gone to that hell hole in Kansas instead of the golf course at retirement village.

COL MURPHY INITIALLY RECOMMENDED FOR COURT-MARTIAL

It took two decades for the colonel's deceit to be discovered - Murphy was disbarred in Texas in May 1984 and Louisiana in September 1985 - but when it was, Maj. Gen. Franc Gorenc, commander of Air Force District Washington and convening authority in the case, recommended court-martial.

At the time, Col. Murphy also faced three counts of unbecoming an officer; one count of failure to obey a general regulation, and three counts of larceny. The last charges are unrelated to his legal duties. At any rate, it looked like Murphy, one of the Fiscus gang, was going down for the count.

That was then. Now, one could say Col. Murphy is indeed "the luckiest man in the Air Force." This "legal eagle" (see related stories box below) was initially relieved of command last year at the Air Force Legal Operations Agency in Washington.

Things looked bad, but Murphy's defense team pulled a rabbit right out of the hat.

It seems part of Murphy's career was doing highly classified work for the White House. Secrecy regulations prohibit Murphy from discussing his actions during those days as general counsel from 2001 to 2006.

Judge Stephen Henley, an Army colonel, ruled that the defense would be seriously hindered in their ability to demonstrate Murphy's good character during the sentencing phrase of any possible court-martial because it might set a dangerous precedent in other cases of personnel with classified backgrounds who faced criminal prosecution.

As bizarre as it sounds, the Air Force Court of Criminal Appeals upheld Henley's ruling and basically stated Murphy could not legally be punished, even if convicted.

That adds up to Murphy walking off scot-free, although it's a safe bet he will put in his papers and count himself lucky he got to retire as a full colonel.

Has justice prevailed in this case, or has Murphy got away with something that lower ranks could not?

Does military music have anything to do with music? Or, to substitute another word, what relation does "justice" have to do with what has transpired in this case? Right.
