Of one thing, we can be sure. Maj. Mark Seldes, a flight surgeon stationed at Kunsan AFB in Korea, is indeed guilty of adultery. He acknowledged having sex with a female civilian co-worker, but strongly denies he ever "raped" the woman, as she claims.
The "victim," whose identity is being withheld by the Air Force, admits to a history of "consensual sex" with the accused officer and testified she "invited" Maj. Seldes into her private bedroom quarters before she took a sleeping pill.
The accuser even acknowledged the condom used in the "attack" was part of her private stock that she kept in the top drawer of her dresser in her room. She testified she'd had a series of "blackouts" in the past, due to heavy drinking, so was uncertain about what had actually happened.
But, she claimed when she saw a used condom and wrapper in her wastebasket, "voila!" She was convinced she'd been "raped." Even then, the woman failed to notify authorities of the alleged assault for several days afterward.
The accuser claimed she "feared" being an object of gossip at the small military installation and also losing her security clearance and job. For that reason, she told the court-martial, she was slow to file a complaint.
In fact, she said after the "attack" on Nov. 4, 2006, she got up, showered, dressed herself, went to the base exchange, watched television and called family and friends. None of the calls were about "rape."
ACCUSER ADMITS TO "CONSENSUAL SEX" PRIOR TO ALLEGED "RAPE"
During cross-examination on the witness stand, the woman acknowledged her sexual relations with Seldes had been intimate (oral sex was one of the "consensual" activities" she admitted engaging in) and testified she invited the officer to her bed and gave him a massage when he complained about a "sore shoulder."
The next thing the accuser claimed, was she remembered waking up after taking an Ambien pill (prior to this, she testified she'd downed three glasses of wine and a can of beer), and somehow sensed Seldes was "raping" her. After going back to sleep, she said, she woke later. That's when she found the used condom in the wastebasket.
On the witness stand, the accuser didn't recall telling Seldes, the alleged "rapist," to "STOP" what he was doing. Those drunken "blackouts" are bad business. Hard to remember much of anything, unless you're making an accusation of "rape." Then the authorities are more than eager to take whatever you say at "face value."
We have already pointed out several days delay in reporting the crime. When she did file charges, a week later, the female knew enough to have the OSI "listen in" on a set-up phone conversation with Seldes where he admitted having relations with her on the date in question.
That nailed him for "adultery" and the Air Force prosecutors were happily "off to the races." They'd nabbed another one. Gotta justify those budgets, you know.
WHAT WAS HER MOTIVE IN DESTROYING THE MAJOR'S LIFE AND CAREER?
By now you may be asking yourself why a woman would make up a charge that could send her consensual sex partner to prison for the rest of his life, as well as cost him his pension, benefits, and label him a "sex offender," thus depriving him of ever holding a doctor's license again.
The clue may lie, no pun intended, in the part of the proceedings where the accuser said Seldes called her up the day after the alleged "rape" and she told him she was "angry" and "didn't want to talk."
The major, hearing alarm bells ringing in his head, came right over. According to the female, an argument ensued where the officer raised his voice in frustration.
"He began to yell," she said, STARS AND STRIPES reported, and when the woman told him to stop, "he said he was yelling at himself and began to cry."
Another possible reason for standing firm on the specious "he said - she said" rape accusation, stemmed from the way others on the tight-knit base treated her. "The hostility got so bad that by the time I left (the base), people would walk by as if I weren't there."
` Could it be they considered her a liar and a fraud; a person with a history of heavy drinking, promiscuity and making up "stories?" Is it possible many people at Kunsan recognized Seldes was being sacrificed on the bloody altar of "political correctness?"
EXPERT WITNESS CITES ACCUSER'S "HISTRIONIC PERSONALITY DISORDER"
The defense team, led by excellent civilian attorney Brent Harvey, zeroed in the accuser's credibility when he called expert witness Mary Connell, a forensic psychologist, to the stand.
She told the court that the accuser "has at least five of the eight indicators needed to diagnose histrionic personality disorder." The doctor explained that people suffering from that condition are "highly emotional and show attention-seeking behavior." Like becoming a "victim" and sending an officer to prison, perhaps for the rest of his life? Hmmmm.
Air Force JAG prosecutor Capt. Derek Rowe demanded Seldes receive eight years in the slammer at Leavenworth and forfeit all pay and allowances. His attack-dog colleague, Capt. Ryan Hendricks, tried to paint a picture of Maj. Seldes as an absolute ogre."
"He's a sexual predator," the captain exclaimed. "As she (the accuser) lay there, the perfect prey, the perfect victim, he pounced."
Well, at least Hendricks knows what the writing technique of alliteration is. Maybe we can offer him a job here at MilitaryCorruption.com as an office boy. That is why we were "gender-blind" in defending a female Air Force officer who was being forced out of the service a year before reaching retirement. Her lesbian lover had broken up with her and ratted the nurse out to the salivating OSI. Or, when we recently took up the cause for another nurse, a female Army lieutenant in Iraq, who shot herself after a mental breakdown triggered by the steady harassment of a cruel male supervisor who deserves to have his butt kicked around the block several times. The Army tried to court-martial the genuinely ill female for, among other things, "illegal discharge of a firearm." Yeah, right, guys. She pulled the trigger and fired a round into her abdomen, she was so desperate, and you idiots haven't anything better to do than to try and send her "over the edge" for good.
This web site has defended female civilian workers on military bases, women enlisted members getting a raw deal from their commander, and female family members of those unjustly imprisoned and railroaded into the DB. As for Maj. Mark Seldes, he deserves punishment for cheating on his wife as well as conduct
unbecoming an officer. However, for the Air Force to utterly destroy this man and deny him the right to earn a living from his profession or walk down the street without being the object of fear and loathing, that is the real "crime" here.
Why did Seldes not show up for his sentencing? The authorities are providing few details, but as of press time, what we do know is this: He was "apprehended" after offering "no resistance" walking "out in the open" on the base. Which leads us to believe he may have had a psychological breakdown. No one in their right mind is going to go A.W.O.L. "before" sentence is passed. That would just add more years to the incarceration.
We don't know if this so-called "rape" occurred, or not. But we do know this. It happens far too often throughout all branches of the U.S. military, and it should be punished to the fullest extent of the UCMJ. The honest and truthful women who need to be heard and receive justice are hurt by any false accusation, especially a case like this one. Genuine female victims of rape and sexual assault deserve better than this. Real cases of such crimes are always undermined by the false accusers.
