When Kendall County District Attorney Bruce Curry walked out of the courthouse in Boerne, Tex., he was clearly a happy man.
The arrogant and abrasive politician thought he’d finally succeeded in “blowing off” the obvious torture/murder last April of Air Force Col. Philip Shue as some sort of “bizarre suicide.”
Despite mounting evidence of foul play, and growing public opinion that a “cover-up” was in progress, Curry managed to convince a grand jury – you know the saying about them: that a DA can get a grand jury to indict a ham sandwich – to see things his way. In other words – Shue severely mutilated and then killed himself in a car crash with no apparent motive.
The DA’s smirk seemed to say: “Nothing more to see here, folks. Let’s move right along.”
The FACTS prove otherwise!
A “SUICIDE” THEORY FULL OF HOLES
Only an idiot would believe that the staff psychiatrist at Wilfred Hall Medical Center in San Antonio would slice himself open at the chest; deftly cut out both nipples; sever the last digit of his left “pinkee” finger; and cut off an ear lobe. All this, while neatly wrapping duct tape around his ankles and wrists!
If we “buy into” Curry’s preposterous tale, Col. Shue then drove his car erratically for several miles down Interstate 10 before “aiming” the vehicle at a clump of trees where he allegedly tried to “kill himself” in the subsequent crash.
A children’s fairy tale would be more believable than this baloney!
Kendall County Sheriff Henry Hodge knows better. He has vowed “the investigation will continue” and said he might even call in the FBI to study some of the most troubling aspects of the case.
The sheriff’s remarks, first made on San Antonio’s news-leader, KENS-TV (Channel 5), was a direct “slap-in-the-face” to DA Curry, who has crossed swords with the sheriff many times in the past.
Judging from the results of a poll in the Boerne STAR – more than two-thirds of the newspaper’s readers responding to the survey said they did not believe the “official” story that Col. Shue had killed himself – the public thinks the sheriff is on the right track.
WHAT”S THE MOTIVE FOR A “COVER-UP?”
Why the extraordinary effort by Curry, controversial Bexar County Medical Examiner Vincent DiMaio [see our devastating investigative article on DiMaio below in the related story list], and the Lackland Air Force Base Office of Special Investigations to “cover-up” the real cause of death?
Besides the shameful fact that many homicides in the U.S. military are routinely written off as “suicides,” officialdom has a very good reason to make sure the Shue case gets “put up on the shelf” as soon as possible. Bad publicity would aid BRAC, the (Base Realignment Commission) in targeting Lackland AFB for closure next year. That would result in many jobs and millions of dollars lost to the local economy.
A “messy” murder case, in which the OSI would have to explain its disgraceful abuse of the colonel’s widow, retired Air Force Lt. Col. Tracy Shue, and tell why they rushed a “suicide” finding, despite significant evidence to the contrary, would be a scandal the Air Force can ill afford.
COLONEL’S WIDOW DEMANDS THE TRUTH
With the OSI, district attorney and medical examiner all “singing from the same song sheet,” usually that’s sufficient to stifle any family objections to a “suicide” cover-up.
But no one figured that Tracy Shue would prove to be such an articulate and tenacious fighter for the truth. In many cases, family members just give in to an “official” SUICIDE verdict, take the Serviceman’s Group Life Insurance money [up to $250,000], and quietly “go away.”
Not this time.
By all accounts, Tracy and Philip Shue had a loving and long-lasting marriage. “He was everything I could have asked for in a husband,” the widow told MilitaryCorruption.com. “I owe it to our family and Philip’s memory to make sure his name is cleared, and that those who tortured him – leading to his death – are found and punished for their crimes.”
If she does that – and we’re betting she will succeed when the results of Dr. Cyril Wecht’s much-awaited second autopsy are made public in a matter of days – those who conspired to cover-up what really happened could find their careers over.
As for the obnoxious OSI commander, if “obstruction of justice” can be proven – [did OSI personnel “wipe” bloodstains off the outside of Col. Shue’s cell phone to conform with the “official” story he “must have committed suicide,” as he had the phone but (according to DiMaio on Court TV), “didn’t try and call for help?”] – losing retirement and a major’s slot would be secondary to avoiding a long stretch in military prison.
NEW EVIDENCE FIRST AUTOPSY BUNGLED
For the first time in any news media, MilitaryCorruption.com reveals yet another reason why the first autopsy on Col. Shue’s remains was a fraud.
Dr. DiMaio spun a fanciful tale of the colonel pouring topical EMLA (lidocaine) Cream into the severe wounds on his torso to “anesthetize” his body from excruciating pain. We have learned that DiMaio apparently failed to inform the toxicologist at the ME’s office that components of the cream’s presence needed to be validated first. There was no test result to “prove” the cream was even used!
The truth began to come into focus when an independent toxicologist ran calculations on the amount of topical lidocaine cream alleged to have been found in Col. Shue’s body and began asking questions.
“It would have taken 75 to 100 tubes of the cream applied to intact skin to have achieved the cited level of 2.4 mg/liters of lidocaine in the system,” Dr. Nancy Haley told our reporter. “And then Col. Shue would have had to wrap his body in plastic for at least 24 hours to achieve and maintain that level of the substance in his bloodstream.”
We can now reveal that at an annual toxicology conference in Oregon this November, Gary Kunsman (chief toxicologist in the San Antonio Medical Examiner’s Office) was confronted with an independent toxicologist’s findings. He admitted he hadn’t tested Col. Shue’s remains for the components of the topical cream in question. Why? Because Dr. DiMaio never asked him to!
DiMAIO’s “INCOMPETENCE” EXPOSED
“Is this what the public pays this man $207,000 a year for?” asked an incredulous Tracy Shue. “What a horrific act and violation of his sworn oath as a doctor to ‘do no harm!’ For seven months, authorities have relied on inaccurate ‘evidence’ provided by the incompetent Dr. DiMaio. What a fraud!
“From the faulty findings in the topical anesthetic, to the cell phone cover-up, to the misinformation printed in the San Antonio EXPRESS-NEWS by their scavenger reporter spewing the smear my husband suffered from so-called ‘emotional problems,’ the public has been fed lie after lie.
“If this cover-up of what really happened succeeds,” Tracy Shue said, “then they (the killers) who are responsible for my husband’s death will be getting away with murder!”
TIME TO INVESTIGATE THE MEDICAL EXAMINER
First came the fable about Col. Shue committing “suicide” because he didn’t use the cell phone in his possession. In previous stories we were first to report blood was later found “inside” the clamshell device, proving that the tortured and bleeding officer tried desperately to summon help. The operatives who “wiped” the colonel’s bloodstains off the outside of the phone to make it conform to the “official story,” screwed up when they failed to check inside.
Now comes the EMLA cream debacle. No tests were run to detect the substance in the colonel’s body! Both specious contentions were used by DiMaio to buttress his faulty autopsy finding that Col Shue “killed himself.” Both claims have been shown and proven to be wrong!
MilitaryCorruption.com feels it’s about time the American Board of Forensic Pathologists looked into DiMaio’s past and investigated his fitness to retain a medical license in the state of Texas.
“YELLOW JOURNALISM” AT THE EXPRESS-NEWS
Once before, in the series of articles we have done on the Shue case, we were forced to comment about the unprofessional and obviously slanted reporting by San Antonio’s only daily newspaper.
We cited the splash play given to the word SUICIDE in a headline with no “quotation marks” around the term to denote it as opinion and not fact.
A reader quickly scanning the front page of the August 1, 2003 EXPRESS-NEWS could be forgiven for thinking that Col Shue “must have” committed “suicide.” Why? Because of the not-accidental impression given by the inaccurate headline.
In that article we showed how it took “Zeke,” the “reporter,” three tries before he got Shue’s rank correct. We also pointed out the sloppy journalist left out certain troublesome and unequivocal facts from his reporting – such as Col. Shue’s finger joint severed and an earlobe cut off. Was that ignored because it would undermine the “official” version of “suicide?” Only Zeke and his pals in officialdom know for sure.
Now comes this scavenger’s latest attempt to promote one side of the story.
In an article November 25, 2003 on the front page of the local section, “ole Zeke” maintains his usual quota of mistakes, calling Dr. Cyril Wecht, for example, a “forensic psychiatrist” instead of his real title as forensic pathologist. Big difference there, Zeke. Doesn’t anyone edit your copy?
“That lowlife misquoted me, he put words in my mouth,” complained Joseph Mancuso, an assistant to Dr. Cyril Wecht.
“I wish I’d never spoken to him,” Mancuso moaned to MilitaryCorruption.com. “I should’ve known he’d twist whatever I said to fit his own agenda.”
Mancuso was especially livid about the line: “Also lacking was conclusive physical evidence that Shue had been attacked by others . . .”
“I never said anything of the kind.” Mancuso complained. “The nature of the multiple wounds on Col. Shue’s body indicate he was tortured by persons unknown.”
COL. SHUE’S WIDOW FIGHTS BACK
Tracy Shue is even more outraged by the reporter’s behavior.
“Zeke MacCormack had the gall to call me up and read back to me my own testimony before the grand jury,” she told MilitaryCorruption.com. “How does he even know what was said? Did he violate the law, or did his buddy Bruce Curry leak actual testimony to him? Who do these people think they are?”
Shue choked back tears as she told of how the aggressive “reporter” laughed at and “mocked” her. “Then he hung up,” she said.
“That’s the last time I will ever speak to that cretin. If I have to get a restraining order on him, I will. He won’t harass me or my family again.”
