In a victory for justice and common sense, a federal judge has ruled a much-decorated flight nurse must be reinstated by the Air Force as soon as possible. If Judge Ronald Leighton's decision in Tacoma, Wash. is not overturned on appeal, that means Maj. Margaret Witt's pension is saved and she will have an opportunity to continue her good and faithful service to our military without further hindrance.

We want to emphasize, gays in the military is a serious question, with many opinions and no easy answers. Maj. Witt was "ratted out" to her commander by a phone caller. She was labeled a "lesbian," and in violation of the military's own "Don't Ask, Don't Tell" (DADT) policy, the nurse was ordered to truthfully answer her colonel's illegal question as to her sexual orientation. Did the Air Force prefer she lie?

This woman is no "in-your-face" bull dyke. She, by all accounts was an exemplary medical professional. In fact, Witt was decorated for saving a life while on deployment to the Middle East.

Her picture was used in recruiting posters. Her efficiency ratings were always top shelf. That is, until that phone call. Then the mindless bureaucrats in the Air Force set out to destroy her, and what better way than by taking from her what she had devoted her life to? In fact, why not make her forfeit her pension and benefits, just months shy of qualification? Yeah, that's the ticket. That'll teach the - - - - -," some said. All it did, in actuality, was show how cruel and stupid some people can be.

JUDGE ON BASIS OF CONDUCT, NOT "SEXUAL ORIENTATION"

Why can't commanders differentiate between "misconduct" and "sexual orientation?" If you have a military member who does not flaunt their predilections, does not have affairs with members of the unit, or even military people not in the unit, and Witt's "gal pal" is and always was a civilian, why not judge individuals on behavior instead of what they are? We here are not "going soft" on enforcing the legitimate rules of the UCMJ. It's just that real justice calls for reasoned thinking. "Witch-hunts" and throwing people in the ditch for "who" they are, not "what" they have done, is un-Christian and hurts morale.

It is ironic that an Air Force flack, Lt. Col. Todd Vician, turned logic on its head when he said: "We are disappointed the district court judge did not agree with us that important military interests were not furthered by Maj. Witt's discharge."

Hello! For nearly two decades, the Air Force spends a small fortune training an outstanding nurse who maintains a spotless record, and then it's suddenly "in the military's interest" to not only kick her to the curb but deny her a well-earned retirement pension? We disagree. In the U.S. Constitution, we are supposed to be protected from "cruel and unusual punishment." Dumping this woman out of the military and denying her earned benefits is an outrage, when you compare it to the Air Force's protection and pay-off of a Jill Metzger or "looking the other way" in the face of the brutal reign of that "bloat-faced bully," Gen. Gary North.

OUR STAND IN WITT CASE WINS AN UNUSUAL BACKER

Within an hour of the Associated Press bulletin, reporting Judge Leighton's principled decision, we started to receive e-mails, dozens of them from people both praising and condemning our views on this case. It reminded our editor-in-chief, MAJ Glenn MacDonald, USAR (Ret.), of the hate mail he got when he wrote an editorial asking for "mercy" for ex-NASA astronaut, Navy Capt. Lisa Nowak. He reasoned, she had "cracked under pressure" and "already had paid a heavy price" for loving the wrong man. He dumped her, and she couldn't handle that. So, do we need to burn the poor woman at the stake? Of course not! She lost her career and will never fly again. Her marriage is over, and she will forever be the object of "diaper" jokes by late-night TV comedians. For God's sake, let her alone.

We hope that Maj. Witt will be victorious in any appeals the Air Force is sure to make, and that when all is said and done, this excellent nurse can continue to provide compassionate and qualified care to her patients. That's all we can ask for. Is that too much?
